So I recently submitted a new variety to NGC, I thought they would automatically assign a discovery label but they did not. They said they assign discovery at there discretion. Well they offer discovery as a pedigree you can pay for so how are you supposed to know if you should just order the pedigree or let them assign it. They are the ones who determine if discovery is appropriate right.

Generally they don't. The TPGs will attribute... somethings

NGC & PCGS use specific references

ANACS & ICG will attribute almost anything in any reference they can get their hands on.

No clue re CACG

But the key is it has to already be in a reference.

If you submitted to VV and received the coin back with a letter saying it was the discovery piece (new variety), well, see above...

Believe it or not, that's not so much true now a days.I sent a couple of coins to ICG for attribution, the coins were not listed in the CPG, and they straight graded them. So I contacted James (VV)and he said to me, now you know, Anacs, and ICG, won't grade anything that's not listed in the CPG. ICG is trying to repair there image, so there being very careful about what and how they grade for now. Anacs is trying to keep there somewhat repaired image since they moved up the gradi.ng tier. It's rough out there right now.
