That's the same coin and if it's still in the original 2x2 (with ink stain) should be an easy return with ebays help.

I suspect we've all been burned on ebay before. I usually take it as a buyer beware situation and try to learn from the experience. In this case, I would say the original photos were cannily chosen to make the coin look better than it is - heavy side lighting makes the raised elements appear more 3d. As regards his calling it BU, there are lots of coins in PCGS holders that are generously graded. Point being that you need to be careful and make sure you know what you're looking at to the best of your ability. If you're not certain and it matters given the price then it's best to walk away.

is it not against ebay policy to post other images than that of the actual subject item?

Thanks for responding everyone. I opened a case the minute I opened the package. But I guess I cant win as this coin was graded "BU" by a "well known coin store" and "peers at a local coin club".

Given ebay's policy, they always side with the buyer, whether they have a good case or not.

So file a request on ebay and return the item.

Please for the future...any wear negates a BU or for that matter Unc condition...I hope this works out for you. Please get some photo grade guides to familiarize yourself with the grading standards.

I know but this is the first time I bought from this buyer. He didn't mention any wear or scratches on this coin and judging by the pictures he took it looked Bu

This guy just outright lied and continued to lie stating that "...club members agreed!!" Get it back to him and get your refund.
