The 1970 in the mint sets were still 40%, but yeah that seller is looking for a fool. 40% are for beginner collectors who need to acquire more oz. for less money, typically they sell for just under or for melt. Since silver coin and bar investment went from 50 million oz/year in 2006 to nearly 300 million oz./year in 2016 it's not hard to find buyers for them. Typically preppers go for these.
Also the post says 1965-70. Didn't they stop making 40% in 69? If there are 1970s mixed in then they would be clad and only worth .50

No 65-70 kennedy's are all 40% silver but as someone already mentioned the 70's were only released in mint sets from denver
