Well, I'm neither and I can't magnify your pics, but because of the marks on the obverse, I'd say MS61-62. It's difficult to say with only 2 photos but I don't see the wear on the reverse he does. The eagles breat does look weak but I think it's the strike. IMHO

Lot of rubs on the cheek so I'm going with a MS-63. Pretty coin though. The fields are very clear.

I would say MS64. The eagles breast looks like a weak strike, not circulation wear.

I see ms 62-63. To be fair I am not qualified to grade ms coins. I can't really tell the difference in mint state grades. They all kinda look the same. And it's almost impossible to grade ms coins from a picture.

Choice BU means MS63 to me, but others use different definitions, and your coin certainly looks MS63. The cheek action keeps it out of a higher grade but the fields look very clean.
$35 is a fair price. Not cheap but reasonable.

If it wasn't for the bag marks on the face and neck it would be MS-64. But the marks bring it down to MS-63.

Thanks for the opinions everyone. This was a coin shop I hadn't been to before so I'm pleased to see that their grading standards line up with what I was thinking and also what other memebers seem to think.

GF - The fields on both the obverse and reverse appear to be nearly mark free. IMO, the bag marks on the cheek will bring this down to between MS60 and 62. Not sure it will make 63. I think you did OK on the price - Orleans mint morgan's are notorious for weak strikes. If you find a fully struck one, they usually bring a very nice premium along with them. Great pickup I'd say.

P.S. I agree with the comment that Choice BU usually means that the seller believes it is at least 63. Gem BU is usually reserved for 65.

reguardless what they are advertised, its the coin not the BU and such that makes the grade..in this case I think its a weak strike on the hair/ear, A better photo of the rev would help tremendously, assuming the breast feathers are in great shape MS-63 due to the face marks,,

The color and luster are beautiful, at least if the pics are true to its actual appearance, so on that alone, I'd say it's a good buy if you like attractively toned pieces, as I do. :)
Technically... I'd have to see it at better magnification, at different angles, and see others of that issue to make a call. It appears the angle obscures the breast feathers somewhat. If so, the reverse appears exceptional, though the angle might also obscure some mars that might be hidden in the darker portions of the field on the pic. Therefore, I'd go with at least MS63, possibly 64 if the reverse is as clean as it looks in the posted pic. Nice piece, overall!

Nice Luster and not a bad strike considering it is from no mint. Bag marks on cheek bring it down to MS 62-63 for me Price paid fair.

MS61 , maybe ms62 , a lot of bagmarks on the face.

I'll go with MS63. Nice luster with virtually no wear, just some bag strikes. True, it does have a bit softer New Orleans strike but nice! I would pay what you paid and be happy about it!
