1939 penny that is silver, is it a mint fault.

Its probably silver plated.

The Weight of the coin would be helpful as well, if you coin looks like a normal penny, just a silvery color it is probably not silver. it was plated with mercury or nickel or spray painted.

the only way it would be silver is if a dime planchet was mistruck, however the size and weight is extremely different and the penny would not look like a fully struck coin, the edges would have little to no design, and the rest of the coin would look mushy.
