Can you just take a counterfeit pen and mark it? or is it bad to make old bills with one of those?

I suggest that you do NOT use a counterfeit pen and mark on the bill unless you really want a "mark" left on your note- that would be just like using a marker on the bill - any marks on the bill will result in a lower grade by a TPG service.
I personally would never ever use a counterfeit pen on any currency I am collecting.

I was wondering what the rule for that was, I have marked a few normal bills and it wore off in a few days.
