Yeah well, if ebay decides the case in your favor they'll remove the negative feedback. They've done it to my negs I've left probably 5-6 times.

From what I understand, they must first determine if the feedback violates their policy. I didn't attack the user just said that dimes sent were not the dimes int listing, which is fact. I told the seller they are welcome to try to have my feedback removed, but I will not remove the feedback since what I said was fact and the seller admitted they used another listing as a template and those were not the coins in the picture. As far as the second pic, there are dimes where you are unable to see the date. I could ask for a few dollars refund or the 1896 but they don't have it.

The feedbacks that were removed from me simply stated the sellers issues. IIRC, the exact wording of one was "Seller sent me a counterfeit coin instead of the real coin in the listing." Removed after I got my refund. They remove them because of the case decided in your favor. As far as they're concerned, if you get your money back, you're not entitled to leave a negative because the transaction has been, in effect, cancelled. Like I said, I've had this happen about half a dozen times. Another time seller advertised a coin as BU, problem free. I paid about $60 for it. Get it, it's a cleaned to heck AU. I asked for a partial refund, he declined. Opened a case, seller relented and refunded me $40 (premium over melt) and I left a Neg that said something along the lines of "Coin was cleaned and AU, not BU. Partial refund required a case with ebay." It was removed less than 48 hours later.

We'll see, the seller offered a refund but I have to remove the negative feedback as a condition. I told them no since I am covered by ebay Buyer Protection. If she wants to fight the feedback fine.

I'm interested to see what happens, and I hope the neg sticks around. Just seems like a lotta trouble for $2.

I'm not sure of the exact time frame that everything went down, but I would have probably opened a case(s) first, and left neg feedback as a last resort. The seller(s) would be foolish to not do whatever it took to make you happy. First, because they are wrong, and secondly, a negative feedback with as few sales as they have would really hurt them. Just my .02

I don't get it really, they admitted in the case that the reason that the dimes were completely different than the listing because the used another listing as a template and stated that they uploaded new photos that didn't take.

Gotta love this auction of theirs: http://www.ebay.com/itm/121401551209Has a crack? Has been run through a metal grinder more likely. I hope you win your case soon. It's not the value - it's the principal.

They did not send you the coins in the picture AND in the writeup they told you to use the coins in the picture to determine grade. You need to file a claim with ebay and YOU WILL WIN. Do this not just to get your money back but to disclose their dishonesty to ebay. These do go against their account reputation with ebay should they have other complaints. I've filed a dozen cases or so with ebay and have never lost. They are good to work with

Yes, I am escalating to support on ebay. They stated in their ebay listing that they offered refund along with keeping the dimes. They didn't need to offer me that, they could have just did that but they did not. I offered to return them and they pay the return shipping or fair value. I would not pay original shipping as they required. These are both new sellers and do not know what they can and can't do I suppose. Apparently they think that they can send whatever and penalize the seller for returning. As far as the lot that didn't include the 1896, they didn't respond until I gave them negative feedback as well. I took their offer of a $2 partial refund even though I asked for $4 just to be done with that. I guess they learn they can't just list something and then send anything.

I just won my case and was refunded by ebay, didn't take long at all. Anyone notice the changes to ebay's policy after this scenario? Now for item not described cases the seller has to pay for return shipping or ebay may refund the money and tell them to keep it. They didn't require a return. They got negative feedback and isn't being removed.

I would have been angry as well, the dimes sent are a lot worse...and again, why spend all the time and $ for just those dimes. I would appeal to them for a small price break or partial refund...
