Surely ebay will see the item numbers on the first and second claims match. and that the reason for the first claim was an empty package. That IS weird , Try ringing ebay and actually talk to them instead of emailing.

Someone here just doesn't quite seem be on the right elevator floor. They found in your favour and the scammer is on to scam number 2, which won't wash . You win he loses. ebay is not going to rule in his favour. Just when did all of this happen, you do not seen to have sold much lately , looking at your ebay feedback?

I have just sold 22 items over the last three weeks. this was from the first batch of sales about three weeks ago

How can he return something he originally said he never got but that he (or his agent) signed for? Even ebay can see through this...(hopefully!). Keep us posted.

Last update he appealed the ruling and ebay deducted the funds from my PayPal account. I am done with ebay and closing my account after 15 years.

You have to do what makes you happy and if closing your account makes you happy then do it.
So, did he return the items that "we're not as described" that he said he never got in the first place?

File a BBB complaint. I think you can do that even though you're in England, right? ebay will respond to you...within a day or two of when they last can (at around the end of a month after you file the complaint), but they will respond to you. Call them out publicly on their actions, they won't like it.

Since the items were "lost" then no they have not been returned. I followed eBays instructions to the letter. There was no discussion with me just a notification that the funds had been deducted. The buyer did not respond to any of my attempts at communication either through ebay or outside. I am not a huge seller. I do maybe a thousand dollars average a year but that's been the same for 15 years this is just my breaking point. The point where the return on investment does not warrant the effort put in.

I responded to a post about this yesterday, and a member said something in response to what I wrote. I told them I would never do business with ebay again, it's too risky. I may consider like a roll of dimes, but that is about it. This is a perfect example of why I cut off ebay. If a scammer is good, and trust me, there are a WHOLE lot of them out there, they'll get away with it and leave you high and dry. I understand that the prices you get on ebay are a bit better than other places, but why risk it for even a few hundred dollars? I'd rather see it leave my hands, in person, with cash on the recieving end. There are just way too many hands involved. And it'd be nice to have a service centered around bullion, but I'm sure that would go even worse than ebay. Just be very careful, because you don't know what happens along the way, maybe somewhere there is an intern who just doesn't care, keeps a few, and yours happens to be one of them. Sorry for your loss, even if it's $1 to $1000, it's still frustrating because it is your reputation.

When your don't fight the fraud then you end up enabling the fraudsters to do it to others. Yeah, it takes time and effort to fight it, but rolling over and giving in to the fraudster (and ebay) is not the answer. Filing a case with the San Jose BBB against ebay can be done online with little effort. ebay responds to all complaints filed against them. You followed their policy. You must keep emphasizing that in your complaint. Good luck!

I'd still try to get PayPal to cover both parties. This buyer will assuredly get a refund and if you complain to PayPal they might cover your loss. It's worth a try.

I'm so upset after reading this, I just had to respond!! I am also a seller, and this is the most madding thing Ive read. I was under the impression, with tracking and signature confirmation of delivery, the seller was fully protected according to ebay policy!! Why would anyone, employee or not, signed for a damaged package!! You'd want to dispute it with the post office, or like someone said, open it in front of a postal employee. ebay should be aware that scams are routinely run by buyers. The case was probably, an auto decision by a computer somewhere, with no human looking at details. I would dispute this. ebay should make the buyer, explain why they or agent signed for a damaged package!! This would be a very good scam to run. Has ebay even looked to see if the buyer has a history of doing this? I would post on the ebay seller forum about this issue. The link is on the ebay site map. You'd think this is an instance where they'd do a curtesy refund. It really starts to stink, when the guy switched to not as described. To get a refund, he has to return the coins with tracking, so he has proof they arrived. If this guys scam works, what's stopping sellers from claiming a return arrived empty? Thus not having to refund the buyer!! For me, whoever signed for the deliver is the party stuck with it. Since they chose to accept damaged mail, without checking into it first!! When I first started to buy on ebay, in my 2nd month, I had 2 envelopes arrive with bottom slits and no coin. These were $3 items so I didn't make a claim. One envelope was very strange, as all the packing material was still taped to inside of the envelope, it still puzzles me to this day. I wish you the best of luck on this! I would try and talk to a live agent on this. Please keep us updAted, this is distressing to all sellers!!
