So the auction went ok. I double packaged the items and used ebay to create a label and ship so there would be a tracking number. I added signature confirmation. Last night a dispute was opened " Items not received" the PO says they were signed for and delivered. the buyer says the package was delivered opened and the contents missing.. Do I have any recourse? ebay has frozen the funds for the transaction and I am going to assume they are going to refund the buyer.. Yes I know I should have added insurance but I would have made a loss on the items if I had. I feel I did my part as the seller and shipped the item on time and confirmed delivery. I used their approved and suggested shipping method. I would have thought I would be covered under their sellers protection but I guess not. Am I correct in assuming the PO will do nothing since insurance was not purchased?

Was this a coin, if so WAS IT RARE   If you actually are correct in assuming the PO will do nothing since insurance was not purchased then IMO considering you would of lost money in the process its a scam on ebay's part or the po`s part I think. This happen to me once and there's not much that can be done I mean the PO "Should" be to blame because it was in there possession but we don't know who stole it. I re-read your post and what comes to mind is that whoever stole the contents of it stole them from you and not the buyer even though they were shipped to the buyer and the buyer bought it because now your not getting your money and if the buyer does get a refund it will be like this never happen... for the buyer.

This is a frustrating situation and I'm guessing you're correctly guessing the outcome. It's likely the hard reality of the risk of selling by mail. It hasn't happened to me yet as a seller, but just this past week a package I won arrived with a slit in the envelope and both medals missing (they were packaged in individual holders, wrapped in a few sheets of paper, then put in a normal envelope). I feel really bad for the seller (and wanted both those medals for my collection) as I've purchased many items from him. I still actually haven't actually heard back from him.

This is one of my fears as well, but having dealt with USPS in other professional aspects there is not much that can be done. The USPS has become incompetent and indifferent in their secure delivery operations, they have been relegated to the the realm of junk mail and catalogs. Like you, I learned the hard way to ship my coins FedEx for items over $250.

My question is, why did the buyer accept and sign for the package if it was noticably opened? He/she made the situation far more complicated by accepting it and signing for it and then openning a dispute. Is it possible that the buyer is trying to scam the seller (nohope) in this case?

If the buyer signs for and accepts the package and then says oh dear items not here, complain to the postal inspectors and let them handle it. I was a letter carrier for years and if a package for delivery arrived at our desk obviously played with or tampered in anyway, we had to turn it over to our supervisor immediately. Out for delivery ,when getting a signature it is the customers duty to look over the item and THEN sign. Once they sign for it, it is their problem .I for one think you are being scammed here. Good luck. A little visit from your local postal police should straighten this out. Remember even though the odd bad seller is out there , there are many scammer buyers as well.

I believe if you click on the tracking number it will tell you who signed for it. If the intended buyer signed for it he owns it. The post office is not going to accept responsibility for a signed for item. It was the buyers option to accept delivery of an open package and its contents or lack thereof. I doubt seriously that the package was opened when signed for. I smell a rat! nlp

The Buyer needs to take this up with the post office if the package was tampered with BEFORE delivery. (Even if you had purchased postal insurance, once the package was accepted, signed for and delivered the post office was off the hook). The big question is why did he accept it and sign for it if "it had been opened and the contents were missing"? Most likely this Buyer has done this before trying to score refunds from Sellers that automatically cave in. Check his feedback closely for Followup feedback comments from Sellers that may have been burned. Respond to the ebay dispute process accurately and timely. You did everything correctly. If ebay rules against you APPEAL!

I had this happen once, but thankfully, it was just cheap coins I was shipping. The buyer was very polite, and I sent him some more the next week. Ever since then, I get insurance on everything I ship.

The buyer has no responsibility whatsoever here. No more than if he'd bought it from Amazon. Chances are he's scamming, but without Insurance it'll be tough to avoid taking a hit anyway. The only possible angle is that he knowingly signed for a tampered package.

As far as I am aware if someone signs for an item then that is the end of it. all you have to do is provide tracking details to ebay and that should close the case. I have had a couple of dodgy looking packages that I have refused to sign for until I get the postmaster to open it in front of me (With my permission), I told him exactly what should be in the package before it is opened. On both occasions all was good , Simply a repair job in transit. There is a "Tiny" chance that the coin could have been lost in transit, There is an even bigger chance that you are being scammed here.

"Am I correct in assuming the PO will do nothing since insurance was not purchased?" From what I have read in the past even if there was insurance they would do nothing. Good luck with the out-come. I have sold to this guy several times in the past without issue so I would tend to trust him as this was a relatively small sale compared to past sales. He has mail shipped to his business so I don't know if it was him or one of his employees who signed for the package. I will en-devour to find that out. I have fallen to ebays buyer protection before so now I ship with signature confirmation every time. I tend not to use insurance unless the items are over $200. In this case it was $133 so I passed on the insurance and as I said I have sold to this guy several times and even one or tow private sales. so I don't think scam why scam on a $133 transaction when you have had previous transactions over a thousand. The rules are clear its my responsibility to get the item to the seller. I was hoping ebay's seller protection might help me in this case but I suspect its wishful thinking.

Bottom line is if he, or his agent/employee, signed for a package that was obviously tampered/opened, and they failed to say something to the carrier at delivery, then the Buyer is out of luck.

This happened to me with an ecrater coin I sold. Guy stated he received my package but it was ripped open and coin was not there..just my biz card.
In my case, it was an uninsured $15 coin. I just refunded his money but in this case yeah, there might be other options.
