It is valueless. It should be marked copy or destroyed.

Well, I think it's better to find out exactly how much silver is in this thing & sell it at silver price. However, thanks for the help everyone!

I have a question based on this thread - how much silver can a coin (or fake coin) have and still be magnetic?

Depends on how strong the magnet your using is.

If it is fake it almost certainly has no silver content.

It's not a felony to own or sell fake coins unless you pass them off as original. Even if not marked COPY. Jeff

Not any more. Latest updating of the HPA makes it illegal to sell or to even assist someone in selling unmarked copies made after 1973, period. You might be able to legally give them away.
(b) COINS AND OTHER NUMISMATIC ITEMS.—The manufacture in the United States, or the importation into the United States, for introduction into or distribution in commerce, or the sale in commerce of any imitation numismatic item which is not plainly and permanently marked "copy", is unlawful and is an unfair or deceptive act or practice in commerce under the Federal Trade Commission Act.
