LOL- That's funny because that's what I thought when you emailed me through ebay.... is this guy seriously claiming the rights to "I stole it first"? Of course, that was before I found out that you did some work yourself.

While I can understand copyright laws, software licences, DRM's and fully support the enforcement thereof, I have a hard time considering the reappropriation of promotional material as theft of intellectual property. Especially on the resale of sold out (or soon to be sold out) mint offerings. I sold a classic Mustang years ago and part of my advertising of the car included the original sales brochures from the glove box. Should I feel guilty ? In any case, kudos to Dooby Rak on the way this was handled, you went about it the right way with another forum member and settled the issue.

I don't understand, you can't use the original image from the Mint if you want to sell anything? If that is the case, anyone selling the Mint's products needs to ask first their permission to use their pictures?
So what we need to do is take an original picture of the product with our camera and that will have no problem? is that the solution to all this?

When ever I do an auction for a more expensive coin I will always photo the coin the packaging and the COA showing the number on it. I like to provide the mint photo only as a reference since it is very difficult to produce as good an image as they use for their marketing.

" Assuming that you buy coins on ebay, and if someone have 100,000 feedbacks and 100% ratings...then you don't need to worry about fake auction right? We take their feedback ratings into consideration when bying anything on ebay. If someone on ebay sells 500 items from the Mint, they don't have time to take pictures of each and everyone of them...so I want to know if we use an original image from the vendor, is this illegal? I just think that they should have no problem with that, because in a way, you are promoting their products...and who doesn't want that?

Not everyone can take acceptable pics, especially of coins. I've had thousands of ebay transactions over 12 years and never been involved in a "fake" auction. If you are you'll get your $ back. Don't worry about it.

The RCM's IP policy clearly states that the images and text used on its website to promote its coins are not to be re-used without their permission and a possible fee. ebay sellers constantly lift text and images from the RCM site - just check out current GITD Dinosaur listings. If the RCM wanted to, it could pick a few sellers to make examples of in an effort to stop the use of its protected images.

My questions is regarding posting an original image from the Mint's and use that to put in the listing...as I SEE EVERYONE DO THAT. And it shouldn't be a problem in my eyes "because in a way, you are promoting their products...and who doesn't want that?"

I am more than Happy. Instead of go after them.

You asked 'because in a way, you are promoting their products...and who doesn't want that?' My response was 'the RCM' doesn't want that as evidenced by their pressure to stop us from promoting their products via the message in the sticky. Simple.
