If I have a product and people promote my product for free

I am more than Happy. Instead of go after them.

You asked 'because in a way, you are promoting their products...and who doesn't want that?'

My response was 'the RCM' doesn't want that as evidenced by their pressure to stop us from promoting their products via the message in the sticky. Simple.

Some companies provide people or retailers with media they can use freely. I suspect the mint allow their dealers to use this kind of media or charges them a fee to use it.

If spend money to produce marketing materials and people steel them it would make me angry. Especially if they are using it to generate a profit and it does not benefit me at all. The mint does not benefit by us using images or text from their website to sell coins that are out of production. I don`t think they would have a problem with someone posting their art on Facebook or tweeting about coins. I could be wrong based on their attitude here.

That being said the mints product is not music or videos or print media. We`re not really stealing from them by borrowing an image. If they wanted a fee they would make it easier us to contact them and pay a small fee. If they don`t want us to steel their media don`t make it so easy.

I don't understand, you can't use the original image from the Mint if you want to sell anything? If that is the case, anyone selling the Mint's products needs to ask first their permission to use their pictures?

So what we need to do is take an original picture of the product with our camera and that will have no problem? is that the solution to all this?

Actually, no. This is not a solution. The RCM IP rules don't allow for you to take pictures of their products either. Last year the RCM was going after a guy who made an album called the last pennies, had pennies on the cover, and a penny setting (instead of a sun setting) on the back cover. The RCM was going after him for a large sum of money for each album. They ended up dropping the fees, but according to them the image itself is part of their intilectual property.

It is very unlikely that they will go after sellers on ebay for doing this or even using images from the RCM website, but technically they can if they choose to.

I think that is slightly different.... because he wasn't selling the penny, he was selling the album and using the penny as art on the cover. I think that if you are taking a picture of the actual item and selling the actual item in the picture it's not a violation.

I understand. But think of a company like Coke. They are very protective of their trademark and media. Rightly so, they spend millions on developing advertising media and trademarks.

" RCM Intellectual Property" means the coin images, drawings, creative designs, concepts, photography designed for online and offline advertising campaigns, promotions, event marketing and public relations, items, paintings, wrappings, expressions, emblems, advertisements, creative copy, themes, slogans, websites, press releases and work produced by RCM employees and of which the RCM owns the rights.

"Intellectual Property" means any invention or protected information of any kind which may be protected by law, and includes:

•patents under the Patents Act.
•copyright material (literary works, artistic works, films, sound recordings, photographs, themes, slogans, etc.);
•trade-marks and official marks registered under the Trade-Marks Act.
•designs registered under the Industrial Design Act; "design" or "industrial design" means features of shape, configuration, pattern or ornament and any combination of those features that, in a finished article, appeal to and are judged solely by the eye.
•trade secrets, know-how, product plans and other confidential information.
"Government" means federal, provincial and municipal departments, Crown corporations, agencies and public authorities that fall under federal, provincial or municipal departments.

"Commercial Use" means the use of RCM Intellectual Property for online or offline advertising to bring awareness to the organization with the end result being to generate a profit.

From what I read, it is the same thing as long as it is for profit. The first item listed is coin images (seperate from drawings and photography but the actual image of the coin itself)Again, it is highly unlikely that there will be any action from the RCM.

I think watermark a picture if not it's free to use. Just my opinion.

Reporting image theft to ebay does diddly squat. I reported a seller multiple times for stealing my pictures and every time ebay does absolutely nothing about it.

Looks RCM cares about the use "for profit"

If the pics and content used "not for profit", and by quoting the source, will it be ok ?
