I recently purchased a pretty expensive Lincoln Cent set off ebay and have had nothing but problems. I did not receive it and after filing with Paypal it was finally shipped only as a completely cleaned set. As I notified Paypal they told me that I can not file as a Significantly Not As Described claim as they have already processed a Not Received claim. Now it looks like I am out $300.00 plus. I contacted the seller again and he said send it back but I am afraid if I do I will have no recourse. His negative feedback is minimal and Positive was favorable at the time when I decided. I just don't know what to do? Any thoughts?  P.S. The item in question was ebay Item number: 300108565902***Edited by Forum Mom to move to ebay Discussions section***

send it back with Delivery conformation and registered so the clown will have to sign for it and then as soon as you get conformation that it was returned call your credit card company give them the info on the DC and dispute it with them (your credit card company) you did use a credit card? never buy anything this expensive on ebay or anywhere else using anything other than your credit card. if you used your debit card it will be the same as a credit card. but if you did a bank transfer sorry you loose I think. sorry if that is the case. that is a lot of money for a Lincoln set though. I have seen nicer sets on ebay for around 100 or less you wont get all the keys but I don't think you got them with this set anyway or I didn't see any in the Item description. hope this helps Gary too

Avoid ebay, there are plenty of online dealers that are trustworthy.

One in February, two in April, one at the end of May.......Some others with mutual withdraws for "item not sent". Enough red to make me stay away even with the deal of the century. Sorry. The advice on what to do given previously sounds pretty darn good. Keep in mind, the whole dispute part of ebay and Paypal never goes as fast as you want it to. I've been through it, and I certainly didn't get my money back the next day....

Thanks for your input. No credit card purchase. Part Paypal buyer credit and the other part my Paypal balance. I guess this guy figures he can defraud someone once a month and get away with it. Too bad it hit me this time. If you negative feedback him you will get it in return.
I am just curious if I should hold on to the bogus set or risk losing everything and send it back? should I or should I?

send it back with DC and make him sign for it and you will have all the proof you will need for paypal. and with your very good feedback if you word your response correctly nobody will fault you for getting a red dot on your page. I would wear that one with honor. but dont let him get away with it. but from now on only use a credit card when buying on ebay. you are very lucky that it only now got you. I learned that lesson in my first year. my red dot is also retaliatory feedback I gave a neg so I got one. no problem. Good luck Gary too

teebo, File complaint w/ your local PD and his local PD. Be persistent w/ the PDs b/c they will blow you off at first. They will pay him a visit and probably scare some sense into him. Neg him and ignore and don't let him know you are filing charges. Don't bother with federal, ebay, paypal, or Post Office complaints...they will get you no where. Good Luck.You will probably also get a Neg, but Iam sure there are several other of his buyers that are in the same boat as you and also feared retaliation...negs aren't as bad as they appear...just reply to the feedback and state your case.

If he has said that he would accept the return, I'd go ahead and send it back to him with signature confirmation. Save all correspondence with the seller, especially the one authorizing you to return the set. If you do not hear from him within 24 hours of receipt, I'd email him. If he doesn't respond within 3 days, I'd then file a complaint with ebay. For what it's worth, and this is just to help you out, the two most recent negative feedback comments had to do with incorrectly represented coins which is huge. I'd bid on an auction from a seller with 5 negs for non-shipment before I'd bid on an auction with 2 negs for misrepresentation. This says to me that there were probably a lot more that were misrepresented but were never returned. Also, a fair amount of his buyers have few feedback indicating that they are relatively new to ebay or at least have not had many transactions. These buyers may not have known the procedure or were not astute enough to know that their purchases were misrepresented. Given his feedback, I think he's going to want to make good on this sale to avoid a negative. A buyer can pretty much get as many negatives as they want without being affected if they snipe auctions, but a seller is hurt by each and every one. Give him a chance to refund your money. I think it will work out. I also just noticed that he has 13 mutually withdrawn ratings. This makes me think he will honor the return. I'm sure that similar things have happened with the withdrawn ratings, though I did not go through and read the comments. While I know that a lot of people have decided simply not to buy on ebay, there are many good deals to be had if you shop wisely. It is important, even with 100% positive feedback sellers, to scan through the feedback comments. People often leave negative comments in the guise of a positive feedback due to fear of retaliation. It is also very important to see what any negatives were for and whether they were as a buyer or a seller. Normally, the fact that you used Paypal would have been enough to protect you. I was not aware that you could not file a claim for misrepresentation if you filed one for non-receipt. Knowing this, if I ever have to file for non-receipt, I will state that I simply want a refund and will not accept shipment of the item at that time. It really makes no sense that you can't do both, but we all have to work within the same rules.

There are plenty of online dealers that are not trustworthy also. Let's make that clear. I certainly don't want to give the impression to new collectors that as long as you "avoid ebay" you'll be fine. That couldn't be further from the truth. As long as you're an educated buyer (that's why we're here), you can buy from ebay or anywhere else with the risk minimized.

For general info on this topic:
I had a non-shipment for over $300 a few years ago, at time of purchase seller had 100% pos. feedback, than started ripping people off.
SOLUTION: Go online to your state's homepage and locate the state attorney general, mine (Texas) has a link to consumer fruad, go there and download a consumer fraud complaint form, fill out and send one to state attorney general, copy to police dept where seller is, and copy to seller. I got my refund in just a few days.

Also go to the same site in the state of the seller and find the similar site, file one with that state as well if different from your own.
