It is listed with no grade in the listing title, and classified as "uncertified". So I don't think it breaks ebay rules.

No numerical grade in the title or description. ebay rules also state the numerical grade should not appear in the photo, but I think they are more lenient in that requirement.
I think that one's good to go, let the market decide.
Not the best pics but the coin appears to be EF45, so the grading is no further out of whack than some of the approved TPG's. If that black spot is actually on the coin it should be mentioned.
"Dipping" is not considered cleaning...
