The only questionable thing I see in that auction is
"With the rising price of gold, this makes a great investment."
since gold would have to skyrocket to just break even.

I do think the auction was unclear about exactly what you are bidding on. Are you bidding on 1 grain of gold or are you bidding on four 1 grain bars?

But fraud? I don't think so. Asking more than something is worth is not fraud.

Ah, I love these type of auctions, I really do.
If a grown up adult pays $40/grain, they've made a poor decision, and will have to live with the consequences.
If the seller is lying about what they get-say it's 10K, for example- then THAT would be fraud by deception.

Heck if gold ever reach high, oil price should be at least 300+USD/barrel. Unless the USD lost so much value again other major currencies, it's not going to happen as you can't even pay your living expense, much less gold. That of course is another story if some s mess around with the market but then you'll have a massive riot.
