The way I see it your either a business or your not. Do you consistently turn a net profit and/or have the intent to turn a profit. I don't sell much on ebay anymore, but when I did I had an accountant do my books and between all ventures, I have years in capital loss carry forward on LPP. Point being if your not a business it's going to be pretty obvious as you SHOULD have massive capital losses.

As far as I thought, these changes to ebay were pretty standard and shouldn't really be a big deal, but apparently they are to more than a few people. I can definitely say that since the announcement came out....eBay Stealth Account sales have went up 500% :P

LPP (capital gains) or small business, the decision is not yours, if you're audited by the CRA.

It is THEIR decision.

The CRA will choose the one which gives them the most tax revenue from you.
