I'd give it an AU-58 for now, but give it an acetone bath and see if there are any problems not seen right now.

I think it's environmental damage. I would send it in to ANACS to get a second opinion. If it grades straight, then you have a very unique and beautiful example. Really pretty toning but there's only so much you can tell from a picture. Post a link to ebay auction if you don't mind. I dug through my Heritage files hoping I still had this 1862 in my tracked lots. It was from the ANA show. I agree the coin looks authentic. I also think it may have been whizzed. That might be what gives the odd (matte) appearance of the surfaces. They also look incredibly free of blemishes and whizzing helps smooth out little ticks and scratches. Mix in some artificial toning and you get this coin.

@Chester, look at 11 and 12 o clock on the obverse. That's ED, whizzing would have probably removed it.

I think we need emojis with happy dudes flying mint state flags, unhappy dudes waving a dull flag for cleaning, and angry dudes pulling their own ears off for damage to a legendary coin, etc.
