I don't think you would get any collector to accpt that as the very rare 1882 without H penny. It is so worn that all the secondary characteristics to distinguish a Reverse N (which it would need to be for no H) from a reverse M (for the H variety) have been obliterated.
The H on these coins is renowned for being worn away early and many coins have been pulled from reputable auctions for inaccurate descriptions as "no H". So far only about 8 coins have been confirmed as no H variety, so your chances are low!
