Both of these auctions say the coin you see is the coin you will receive but they have the same picture. Is it an accident or a rip off? And should something be done or let it go?

I would send him an email. I see ebay sellers make mistakes like this all the time, particularly High Volume ones.

I sent him a email. I didn't notice until after I sent it that I typed the wrong date in for the coins but he should be able to figure it out.

The listings were put up one minute apart, so I suspect he listed it and got confused and immediately listed it again. He's got 13,000+ feedback so he probably does a high volume of auctions at any one time. Too bad their are bids on both auctions, it would have been easier for him to fix if one had zero.

I once had a seller let me know that they had accidentally done the same and double listed. Gave me my choice of three other similar coins, or an extra credit back

It could be a mistake, but there's always the possibility of it being a "scam" in a loose sense of the term.
