I saw this coin advertised on ebay as MS, but had no hair detail over the ear. I asked the seller how this could be so and he replied that it was a weak strike. Now I'm beginning to doubt that it was overgraded. Its it?

It has the hallmark flattening of a weak strike in the places I expect to see it. In some cases - lower hair on the obverse, outside tips of the wings - this flattening is in places which don't necessarily wear quickly. The images are inconclusive, but I could see myself holding a coin like this in-hand and calling it Uncirculated.

Not that I'd have paid $72 for it, because the equal/greater possibility exists that it's a weak-strike AU55.

I call it a definite AU. My key indicators are the knuckles on the eagle's talons. In this case they are flattened which is usually a dead giveaway for wear. Therefore -> AU

In truth, paleoguy, the talons indicate the exact opposite to me. On a well-struck coin, they remain rounded for a fair part of the wear process, certainly down into the EF range. Flat talons on an AU or better coin is a sure sign of a weak strike.

So the conclusion is weak strike, but still not MS.

Likely, almost certainly, but not conclusive.
