Yes, 3rd party graders make mistakes in both over and under-grading...
For years ICCS had the reputation of being very conservative and most of the coins in ICCS slips were under-graded... it's been a common practice to buy ICCS coins and submit them to PCGS to get a higher grade and a nice slab...
Nowadays it seems that ICCS has started to swing the pendulum the other way and are no longer the standard of conservatism...
Also, they used to have a tendency to downgrade a bit if coin is dark toned as in the one you are questioning about...
The pics of the coin you have posted are not that great... I've tried to enhance them in order to get a better look but it's just not possible to be definitive...
I would say it's better than VF-20, but not an EF... possibly a strong VF-30+...
Very frustrating though that ICCS can't be more consistent in assessment of grades...
Here's a couple of other 1858 Twenty Cent Pieces...
First one is in my opinion over-graded... I would call this VF-20...

This next one in my opinion is under-graded... I'd give it a solid EF-40...
