No they shouldn't, the buyers that leave the guy unjust negatives should be though. Take a look at the listings. He says many times over that the items may or may not work, may or may not be complete, and they are sold as is. Do these people that buy from him throw a brick through the store window every time their scratch-off doesn't win? He makes it perfectly clear its a gamble. Heres his last negative... knowingly shipped junk. Do not buy from. Lights came out of box and in garbageHere's the first paragraph in the auction... This is a 'FREIGHT CLAIM' auction. The photo you see in this auction is the "exact" item we will be shipping you.Now who's the moron? The buyer or the seller? That's a no-brainer. The seller is brutally honest. |

One thing is for sure, this guy has to live on a computer with over 100,000 feedback? If you just cleared a couple bucks on each auction and you did it in a couple of years, well? Not bad for living on a computer and on ebay! |

Even if you state it, you can't sign away your liability. If the buyer expects something to work then they are entitled to have it work.
To state that it MAY not work or it MIGHT not be complete is intentionally deceptive. If the item doesn't work --- state it -- It don't work..
Buy and selling goods and services is not suppose to be a gamble. That's why we have games like blackjack.

At a 1000 negatives a month and 12,000 per year this seller is consistent. Yes, he is right up front about selling JUNK but alot of negitives is that the buyer can not get a return email/phone call, or that the seller could no longer find the item in his warehouse. This is a good example of where the ebay feedback system does work. It gives me the knowledge to decide that I would not touch any one of these auctions with a thousand foot pole. |

Sure you can. This guy has been around for 6 years on ebay. Assuming a 70% rate of feedback left (which is about average) that's almost 600,000 transactions. Thats's 100,000 a year, or 274 a day. I find it extremely difficult to believe that he hasn't been taken to court by many, many of the knuckleheads that buy from him. But yet, here he still is, going stronger than ever. That should tell you something about the legality of what he's doing. |

He covers that too. In every listing, but people don't read. quote:

That statement is suppose to pass the liability onto the buyer. I believe that it's not binding and wouldn't stand up in court. It's much like the non-responsibility statement you get when you park your car in a lot. I know that one won't hold water and I don't think this one would either.
At any rate I would never buy from a person who stated such things in his ads or auctions. I don't excuse his actions simply because he made such claims. I feel that the intent was to deceive.

I strongly disagree. It's fairly obvious (to me at least) that he goes more than out of his way to say it might be junk. |

I get it as long as I tell the customer that I'm a crook and they will have no recourse ,then I'm legal and honest !!
Its their fault for not reading !!
You know maybe legally this guy covers his butt, maybe !!!
But morally he's a vacant lot,, no one can tell me that he doesn't know at least part of the time that the junk he is sending out doesn't work or is broken beyond repair!!
IMH Opinion he's a willing crook who has taken the time to come up with some specific conceptual speech that is intended to place all of the responsibility on the buyer,,
He sets the starting price and then deletes services based on that price !! LOL this guys a gem !!!
What if I applied his ad to coins ? it would be easy to cross over, may or may not be authentic!! may or may not be rare, may or may not be silver ?
Just another smooth wordy CYOA seller ,,nothing new under the sun !!!

We've had this problem before. Remember the people who were selling medals that were covered in 100 mils of .999 fine Silver, directly from the vaults below ground zero...!
the key word is covered and 100 mils. Translated it means there is not enough silver to drop on your scale. But the medal was big..!
I was sure happy when the government came down on the people for deceptive marketing. This person needs the same treatment.

Hi Everyone,
I have to add that by human nature, the prospect of getting a bargain is almost overwhelming. In a way it can blind your common sense and you end up doing things that you would not normally do. You are gambling that you will be the one that does not get the junk! Hence, their "success" if you will! Mike
