That being said, you should reply promptly and calmly to his inquiry while refusing to refund his money, but do call ebay and tell them what's going on. I doubt the automated system will allow him to open a case - it will more than likely tell him the 30 days to do so has passed. More likely, he's already tried to do it and it wouldn't let him, so he's trying to con you directly into giving him his money back. In any case, you definitely should call ebay about it so that if they get any other complaints, he'll already be on record as being trouble and they can shut him down.

As a seller myself I often wondered how many times this has happened to me. This just makes me sick! I would suspect that the majority of people are honest but guys like this just make you wonder. He is a flat out thief to say it politely....that is 100% no doubt the same coin.

I would call the cops!! What he did was criminal plain and simple.

I also sent pantouffle007 a message earlier today on ebay about this issue.
I just received the exact same message as PawnS has posted in my ebay message inbox.
No need for a refund and hopefully in the future he will make sure before saying an item has not been received.

Thanks for all the support. I've been in online for a few years so this is obviously not the first time I've dealt with this type of an issue. 99% of the time it ends with a refund and just gets written off as the cost of doing business. Saying that, I also try to challenge the obvious when possible (both as a buyer and seller) so that people think twice before chronically doing it and possibly save someone else a few bucks in the process. Myself and another Canadian dealer recently won a case with Paypal when a buyer in Europe claimed a non receipt of goods from both of us (within days). So the theory that you should never bother to challenge ebay for untracked item cases because you will automatically loose doesn't always prove to be true. If you can prove fraud (which is not often) then eBay/Paypal have no choice but to rule in your favor. A bigger problem are the atrocious shipping rates in this country (Canada) which forces most sellers to ship regular post for low value items. You can ship the same light packet envelope domestically in the US for $3 tracked in comparison to $9+ in Canada and $10 anywhere in the world where in Canada it is now virtually impossible to ship a coin tracked around the world for under $40 and upwards of $70 where the tracked packed product is not available. For someone like me who deals with predominantly foreign coins, it's crippling. As far as this buyer, it's blatantly obvious that he knew what was going on. I have thousands of coins and yet I remember most of them, how I got them and what happened to them. Most collectors/dealers will tell you the same. Thanks again.

Have you told us yet who this guy is so that we can avoid dealing with him ever? ebay name, paypal name, address etc......Con artists usually don't sue for defamation

The user ID of the alleged fraudster can be found in the link in the first post - for those of you looking to block them.

I agree that Canada Post prices are atrocious. Although I encourage and offer tracked shipping many of the buyer`s invariably go for the cheaper option of standard shipping.
One of the more annoying and potentially costly outcomes is that without a tracking number (proof of shipping) Paypal and ebay will always come down in favour of the buyer. I have had buyers, especially from overseas and the US, make a claim for an item not delivered in less than 2 weeks from purchase. They have not allowed for Customs delays or the fact they chose the slowest method of delivery. Once the claim is rolling and YOU are unable to prove delivery you are out of luck! If the person you are dealing with actually receives the item during the process of the claim and is dishonest enough not to let you know then they get their money back and keep the item with impunity.
I am now selling with a limit where all purchases or combined purchases over $75 will only be shipped with tracking. This seems to have done the trick for higher priced items and I haven`t had a single claim for any of the tracked packages but this hasn`t stopped for items just under my threshold of $75. I feel that I may have to reduce this even further to $50 and although I don`t want to penalize my regular customers this is the price one has to pay due to the odd crook out there.

Footnote: A tracked package that was mailed to Michigan on July 06 arrived today July 19 at it's destination, a total of 13 days. You may think this is not too bad from Canada to the US but here's the rub.... The distance from my address to the recipients is 300km, about 4 hrs by road!
