The scratches are congruent on both coins. I call them the same coin.

That's the same coin, absolutely no doubt about it. The seller is a thief. He sold at a loss and now wants you to cover it. What recourse is available to you? What does ebay say?

Yep, look at the scratch just west of the chin. It is long and kinda curves at the end. I hope you resolve this issue to your satisfaction.

What a scumbag! I wonder if law enforcement can get involved?
That's why I track everything. If it says delivered and the seller says otherwise, I know.

ebay will do nothing, despite the overwhelming evidence in the photos presented. They will resort to their usual defense " ebay is just a venue and we are not involved in disputes between sellers and buyers" You should bid on the coin, win the auction and then claim you never got it

In my opinion this is fraud and warrants criminal consequences for the responsible individual.

I know ebay usually sides with the buyer but if ebay doesn't side with you on this one there is something seriously wrong. Just added that user name to my blocked list as well.

So far I'm not out any money so I can't really do anything other than call ebay and complain about the offending userid. I spent 2 hours with ebay today on another matter and just don't have another 2 to explain this scenario. Forums like this are probably just as effective. The ebay CSR will look at the picture and say "Well that doesn't look like the same coin...". What got me curious about the email complaint is the amount of time that has passed, also two coins were shipped together but there was no mention in the email about the other. One thing leads to another and voila... For the record here is the content of the email "Dear thecoinhunterca, I would like to know at which moment I am going to receive my purchase because I still received nothing and it makes for a very long time xxxxxxxx"

What an absolutely infuriating case.
Not only did this charlatan try to defraud you, but he ruined a beautifully toned coin in the process.

On the bright side, you're now past the 45 day limit where they can open a case and Paypal forces you to do the refund aren't you?

It's past the 45 days. Either way I never heard from the guy once I pointed out the "problem" to him. I doubt he would have tried even before the time lapsed. It was just the point of the whole thing. It's disappointing to see people still try this stuff which ruins ebay for many legitimate vendors. Everyone can make mistakes. I just accidentally sent an empty box without a coin to a customer. Dumb stuff happens to everyone on the rare occasion, it's how you deal with it after the fact.
