Need lighted photos. These do not show center shield on reverse or fields on the obverse well enough for a grade.

Especially if it's a difference between 58 and 63.

Mox is right, better pics are needed to provide any grade with a good margin of accuracy. This becomes especially true when dealing with smaller coins. Assigning a grade from a pic is always a difficult process as pics often do not capture critical components relevant to a grade (such as luster) and often times are taken at angles/with lighting to hide certain flaws, such as hairlines, etc.

Having said, based on my knowledge of German Empire coinage (and I'm pretty familiar as I have many samples), and the above pictures I would say that this coin is easily an MS coin. All the high points are intact, and to my eyes, do not show evidence of wear (the crown, the claws, the tail, and the cross). Do note that this coin may have been dipped, cleaned, contain hairlines, and other imperfections that the above photos do not show. Also, those black stains (especially on obverse, left of the '5' below "Deutsches") can be PVC damage. If the coin is clean and demonstrates luster I wouldn't be surprised to see it grade in 62/63.
