From the first pic there appears to be a couple nicks on the sun.
Probably max MS-68.

Very nice coin. I understand where you are coming from on this one with the big spread between 69 and 70 grade.

The "spots" mentioned do not seem to be there in the lower pic so it would have to be in hand to properly grade. I see nothing else with the coin and might take a low risk chance of having it graded IF I were having others graded also. Costs a bit just for one coin with shipping etc.

I should add I am definitely not a bullion grading person BUT, with that siad, the actual completed sales prices for an NGC 69 vs. an NGC 70 is ridiculous but real....around $30 for a MS69 and $800 for a 70

Stats are against you with 110,477 graded and only 615 receiving 70's...but...there are 615 happy collectors out there somewhere

I do have a roll/tube of these..maybe I should give them a looking at

Even the smallest mark or hairline keeps you from MS-70. This one looks MS-69 because of the marks on the sun.

...assuming they are there I would agree but they are NOT there on the second view thus the importance of viewing in hand
