If a person has a penny that was struck by a new die and the images and devices are very crisp. Then all surfaces have no wear and there are no dings or scratches. The only thing is that it is brown not brilliant. If it were brilliant red it is MS 70. Could it still be MS although it is brown.

Mint State is based on wear, i.e. no wear. Nothing else matters. This applies to ALL coins.

MS-70 is impossible to achieve on a Lincoln unless it's a modern proof. The highest graded coins are MS-69 and those are exceptionally rare. Check out the 69/70 columns in this list. LOL
