So, I ordered an SLQ album on March 19th. The expected USPS delivery date was between March 24th and April 2nd. The seller had shipped it and the last status report was March 23rd in New Jersey. I emailed the seller with my concern and he just told me, "either you will receive it or it will come back". Now it's April 21st, and this is by far the longest I've had to wait for an item. I know this is a dumb question, but I've not been in this situation before. How long should I continue to wait? If it's lost, is he on the hook for a refund, or do I eat it? I'm sure it wasn't insured.  Anyways, any advice would be helpful. thanks in advance.

did you buy it on ebay? if you did post a pending complaint you only have so long to do it. I got screwed by that once before

Yes, on ebay through paypal. Should I tell the seller I want a refund? I'm not sure it's his fault, more likely USPS fault.....so.

Go through the report a problem link on ebay if he doesn't want to cooperate.

i am interested in this as well - just bought a half penny which was delivered, but not to me. The seller is a real nice person (exchanged emails) so I am uncertain of what to do as well. It was $40...

johnny54321, It has been plenty long enough, you can file an Item Not Received dispute through PayPal. Here is the phone numbers to PayPal. I've been through PayPal disputes several times both as a buyer and as a seller. They are very helpful and can explain the process...

I would not wait any longer, as you only have 45 days to file a dispute with PayPal. The seller is always the one responsible to get the item to the buyer in the advertised condition, contrary to what a lot of sellers would like you to believe. If the seller can not provide proof of delivery (i.e. Delivery Confirmation), you will receive a full refund (the original purchase price plus shipping).
Auction terms like "I am not responsible for lost/stolen/damaged packages blah blah blah..." mean absolutely nothing in a PayPal dispute. PayPal policy trumps seller terms in a dispute. As far as the package being insured...that is the seller's problem, not yours. Contrary to popular belief, insurance protects the seller, not the buyer.
needgames4lyfe, Your situation is a little different. When you say the half penny was delivered, do you mean that the Delivery Confirmation number shows "Delivered"? (assuming is was shipped through USPS). If that is the case, the seller is off the hook since there is proof of delivery. Your issue will be between you and the Post Office since it sounds as though they delivered it to a wrong address. Unfortunately, Delivery Confirmation numbers do not show which address it was delivered to.

You certainly shouldn't take the brunt of the loss. I'd try to work it out with the seller......is there any tracking by USPS? When mine arrived last week, I thought about yours that had taken a while. First - try to contact seller and work it out, 2nd report it through Paypal and ebay to attempt to get refund. As for feedback - it depends on the sellers reactions. If they are cordial (even without a direct refund) I wouldn't go worse than Neutral. That is because if they truly sent it, untracked and uninsured, then a full refund means they bear the full brunt of the bad situation. Sucks when this happens, but it is the peril we play with for buying on the net.

first file a complaint with ebay, your probally on the border of can you still do it. Then do what other people are telling you. You have to initiate the process in a timley manner, otherwise paypal/ ebay will do nothing. Sellers cant have people going after them 3 months later, b/c then people could do it if they came up on hard tiems and just needed money.

yea, mine says delivered. Oh well, I guess it is a lesson learned (although two months of my coin budget just 'disappared')

needgames4lyfe - check with your neighbors.
I had some silver barbers delivered to the house 3 doors down once. The lady there said she came by my house but no one was home so she didn't leave them, brought them back to her house, put them in her den and forgot about them. She remembered a week later, just as the seller was about to refund 1/2 of the $$. You never know.....the USPS isn't the most efficient organization out there you know.

Being a buyer and seller on ebay I believe it is the SELLERS responsibility to ensure that the items are delivered.I take care to be sure that anything over 10 dollars has delivery conformation and if it's over 50 bucks I pay for insurance.I learned that the hard way.I sent a package to one of the members here and when the member received the envelope it was practically torn in half and all the coins were gone.I didn't insure that one but I was new to selling and it made me feel pretty bad.Lesson learned.Now if I buy something on ebay I request insurance as well and gladly pay for it.

A good many of the non-USPS employee mail carriers do not have scanners in rural areas so everything is scanned as delivered when it's loaded in their vehicle in the morning. The PO will not admit that, but I've seen it with my own eyes.
