They used the word, "Proofed" instead of Proof. I know they did not make a ASE Proof in 2009 so what does Proofed mean?

Check the second image (reverse) of this coin it has a DC mintmark added to it and the small print on the package explains it a little.
but is it legal to do that to this coin?

It's been "Proofed" and "Re-Proofed" several times. It that legal? You know, I'd buy a couple if the price was reasonable just to have the oddity. I guess where the government fails to perform, commercial enterprise steps into the market.
