Looks like a rough VF-30.

The 1938-D was generally well struck and was saved in large quantity in high grades. The Denver mint over-used the dies, however, trying to meet the demand for the last year of coinage, so early die states justify a premium. Your coin is average strike, with a bit of surface roughness, especially on the obverse. I can't see enough second feather detail or enough clarity on the cheek, eyebrow, and hair to go VF-30 on the obverse. The reverse doesn't have enough horn or front leg and shoulder detail for VF-30. I'm at VF-25 here.

That said, can you snag a high resolution photo of the mint mark?

JMHO, but for photo enhancement, try paint.net. It is freeware, with some excellent adjustment tools. It's worth helping out the developers with a purchase. I use it all the time.
