RES IPSA LOQUITUR - Lat. "the thing speaks for itself." Refers to situations when it's assumed that a person's injury was caused by the negligent action of another party because the accident was the sort that wouldn't occur unless someone was negligent.

quote:
A Latin term meaning "the thing speaks for itself." Res ipsa loquitur is a legal doctrine or rule of evidence that creates a presumption that a defendant acted negligently simply because a harmful accident occurred. The presumption arises only if (1) the thing that caused the accident was under the defendant's control, (2) the accident could happen only as a result of a careless act and, (3) the plaintiff's behavior did not contribute to the accident. Lawyers often refer to this doctrine as "res ips" or "res ipsa."

That's what I got from a search...

And the plaintiff's laywer responds that you did not let it speak for itself but took it upon yourself to speak for it and it is your comments for which you are being sued.

You have to remember that in court right and wrong has no meaning or importance.

Oh boy...if this thread serves to prove anything, it would be that you don't want to get taken to court!

I nominate this thread for the Perry Mason Forum Award™

AGREED

So how do we/can we get rid of them?

The consensus is that we can't tell anyone or we'll have to go to OMG should I say it? COURT!

I never said you should be scared of going to court as some would make it out, I just wanted you all to be aware that it could be the place you end up if you are emailing buyers of this guys auctions. Like I said the only reason I said anything is because I care what happens to each and everyone of you and wanted you all to be aware so you couldn't say well I didn't know this could happen when all I was trying to do was give someone a heads up

If you go to the messages section of your 'my-ebay', contact customer support under the subject 'Replica and Counterfeit Items'. It will ask for item numbers, and it can be very effective as ebay may stop the auctions before a buyer becomes involved.

Thanks to KurtS and NGiles for posting the images - this is a real education for me, and it didn't cost me $5 grand. I'm glad I found this board.

Sorry, could not resist...

But I agree with nobble, this day one has to be a little self-centered when offering assistance. Many criminals these days are successfully suing their victims just because they dared to fight back!
