If it's counterfeit it's a really good one. I'd guess MS-64 grade wise and I presume luster is good, just not evident in these images.
Can you get a solid guarantee on authenticity?

I think it's genuine, but it also looks overdipped. I'm not convinced the lack of luster is just the photos—you can see light reflecting off the Mylar, but not on the coin. You'll have to assess it in hand, but if it really has no luster, it might be a details coin.

the upper loop on the 9 appears to a bit wonky and not rounded. based on the comments and the fact that if it is genuine it has been a little over dipped i'd pass on this one and not take the chance

Potential counterfeit issues aside, you should not be paying a premium for a spitting eagle VAM over a regular old 1891-CC. There are at least as many spitting eagle 1891-CC coins as there are ordinary 1891-CCs (source: Carson City Morgan dollars by Crum, Oxman and Ungar).

Dead luster is due to being overly dipped. Will only "details" grade due to cleaning.

Sometimes you can learn more about a coin by checking on its neighbors. I found the seller of the OP's coin, and compared it with a different BU Morgan he has listed. These are the seller's photos using the same setup and lighting on both coins. Clearly the second coin has decent luster, while the 1891-CC looks dull and lifeless. I would avoid this coin as it definitely doesn't have original surfaces.

If it's fake it's a well made one. Compared image to my spitter and the 9 looks slightly different otherwise it looks fine, not sure, I think it's real but I would avoid this coin.
