Attractive coin but I don't believe it's MS.
The seller never indicated it was MS so it doesn't matter.
I buy what I like also. Looks nice.

Looks like a lower grade coin that was dipped, polished up a bit, and retoned

XF-40 perhaps

Yea trust me I'm not worried about the condition on this one. I dont even collect these things. I just really liked the toning (dipped or not) and I hope to use this one to help my photographic skills a bit. This coin should present a few problems which will help me get better.

I will also say that I went back to the online photograde at PCGS and would easily agree the grade is around XF45 if there's no luster on the coin (which there doesn't appear to be much if any). So if thats the case, the coin is pretty much worth melt + any value you would add for the toning. That of course is dependant upon the buyer so one could aruge it adds $0. At worst I paid double melt. At least its not hunderds of wasted dollars!

Toned coins are damaged coins...that coin is worth about 14 or 15 dollars...thats sad that you got ripped off.

Beauty is in the eyes of the beholder.
Lots of people love toned coins and will pay extra for them.
In most instances I don't blame them
