I recently purchased an XF40 1858 LL Flying Eagle. When I received it, I noticed a broken wingtip and also a die chip above the first 8 midway between the 8 and eagle's breast. There is also a trace of the 7 above the last 8. On Rick Snow's website he has an 1858 graded XF40 that is also not designated 1858/7. He even comments in the description that he is puzzled that they didn't catch it. It appears that the grading companies don't automatically designate if a variety exists.

Correct. The submitter of the coin needs to tell the TPG which variety they think it is and pay an additional 'variety attribution' fee. Otherwise it will not get annotated on the label.
