I realize condition isn't very good and there is what I believe to be pencil on the back but, is this an error?

I believe the note has had a number of post BEP distractions added to its original appearance...the stain being one of them. It has a pencil annotation, many folds and normal wear and tear from circulation. I do not believe the stain happened at the BEP and it would need to be seen by an expert for evaluation.
