Just an update...this seller just received yet another negative feedback since I first started this thread today. I am REALLY worried now if I will ever get my cd...

Oh, your problem has nothing to do with YOUR account. This one is easy...just file a dispute with Paypal. They will automatically side with the buyer unless the seller can show proof of delivery.
I hate Paypal for this very reason, because it's not always the seller's fault when things go wrong, but as a buyer you're in good shape. You'll definitely get your money back.
With that many negs all at once, the seller's account will likely be suspended very quickly.

I will give a little more time but then I will file a claim, leave a negative feedback, then I will generously get a retalitory negative feedback. I know this has no bearing on my account but I was curious if this seller will get the axe for all the negative feedbacks being all at once. I will say, if this seller had all these negs when I first bid I would not have bid at all. But the seller didn't get all these negatives until after I purchased the item.

That's really interesting. I did not know that the star ratings are worth that much to a seller. I cannot believe ebay uses that info to limit or suspend accounts. You see, if the buyer didn't like the item, but everything else was fine, do you think the buyer is buying to give a 5 for everything else and a 1 or 2 for description of the item? No, they will 1 it across the board. There are many powersellers who have only 99% or so + feedback with 10,000+ transactions. Do the match. That means 100 negative transactions. How can you get a 4.8 out of 5.0 for S&H when seller doesn't charge S&H fee? The only thing I could come up with is that the seller didn't package things well and get a few low scores for poor packaging.

For the same reason that buyers give sellers Negatives when the USPS takes longer than they want them to, even though the seller shipped within 24 hours. They don't have a clue. They want instant gratification. My only two poor experiences with selling on ebay both involved buyers who got ticked when their coins weren't in-hand within 48 hours - they both emailed me on Wednesday after winning on Sunday, asking why they didn't have their coins yet. And ebay is making it impossible to call attention to buyers like this any more.

Just another update, the seller got yet another negative feedback overnight and has 3 consecutive negatives.

File the claim with Paypal now. You don't have to wait and it's clear you aren't going to get your item.

I opened a dispute with PayPal today. I feel I gave the seller plnety of time to comply. I'm in a tough spot though about leaving negative feedback. This seller has left EVERYONE a negative feedback that left him one.

I did get the cd a few days ago. But it was misrepresented. The photo in the auction clearly showed the cd to have an explicit lyrics label. The one I ended up getting does not. I contacted the seller via the PayPal dispute center about this matter and I haven't heard anything back in a few days now. I would not have placed my bid if I knew the cd was the clean version. I don't believe in censorship. Anyways I just sent another message asking for a refund and offered to send the cd back at my expense in order to avoid escalating the dispute into a claim with PayPal. If I filed a claim, I am not sure how PayPal would rule this case. I mean I did eventually get the cd, although late and it was in perfect condidtion. However it was not what was shown in the auction. Advice? For the record, the total cost with shipping was $30.74

Alrighty, the seller has agreed to issue me a refund once I send the cd back. I will wait until I have the refund back before I close the dispute on PayPal. I just hope the dispute doesn't expire before I even get the refund.

It has been a while. I asked the seller when I can expect a refund. Seller tells me when he gets the item back. This was today. Now my delivery confirmation shows it was delivered on February 19th. How could it possible not have arrived when delivery confirmation says otherwise? Is he pulling a fast one?

It doesn't matter if he is or isn't. You already filed with Paypal. You just need to provide them proof of the return and they will refund your money.

On Paypal I only opened a dispute to get the communication flowing. I have not yet escalated it to a claim yet. Maybe I am being niave for wanting to get this worked out before the need to escalate this dispute into a claim. Now that I think about it, I should have gotten signature confirmation.
