Maybe someone else has the software and the time to overlay it with position #4 and see how well it fits.

IMO, this coin is legit. Diagnostically, it appears to fit well with pic #4. The coin is kind of banged up. This would result in some post mint damage. I think that's what happened to the upper part of the mm. The V.D.B. does appear to be weak, but also looks genuine. He also has a 7-day return policy which is always good. Position looks good for #4, but the shape of the MM seems off. Also the center crossbar of the B appears to go straight across. It should slant upwards.

I agree with "fake". The "S" appears questionable as does the vdb. The apparent wear on the vdb doesn't work with the apparent wear on the rest of the coin and the vdb is typically somewhat hidden from normal wear and tear as a result of positioning. Thus, it should be more apparent. Also, you'd have to see the "B" up closer, but the center bar of the B should slant upwards slightly from left to right to be legitimate. The buyer of this coin should purchase it contingent upon getting it in either an NGC, PCGS, or ANACS slab. That's the only way I would do it.

The font on the S looks off to me, but it could have taken a hit and become somewhat distorted.

I could go either way on this one. I would definitely like to see this one in hand before making a judgment.

From what I've heard the location of the Mint mark was place by hand so a large variety is really possible. From the photo too it is difficult to properly inspect the coin and for all anyone knows, the coin you see is not the coin you get. Of course there is that return policy but that doesn't get you enough time to send to a TPGS for authentication. And as already noted some fakes are missed by some very experienced dealers. I knew a dealer that had been in the buisness for over 50 years and he bought a faked 16D Mercury dime. Odd thing is he sent it in once and it came back fake. Sent to another place and it came back OK. HMMMM. So if he doesn't know and some TPGS's don't know, I sure don't.

It almost looks like there is indentation around the S like someone struck it there and the VDB looks weird as well.

Like I said, IMO, this coin is legit. Having said that, just save yourself all the headache and concern, and buy a reputable TPG graded specimen.
