It has a gem look but I see two scratches above the eye and the brow that may keep it from gem.

I hate this because I'm probably wrong but AU-58 . Looks like wear on top of his hair braid , maybe a little wear in middle of hair, face and rub on date . The reverse is drop dead gorgeous . I'm stuck between a rock and a hard place with this coin . And yes the numerous small hits on obverse doesn't help this Nickel .
