I have seen some 2012 ASE on ebay (presale) but they "super-imposed" in an NGC slab already. I looked up the S/N and it was for a 2010 ASE, same grade as advertised. Would this (showing an edited date on the slab, I don't remember if the date on the ASE reflected 2012) be considered an illegal practice?

I don't know if this would be considered illegal because I have seen some TV shows like "Coinvault" pre-selling 2012 ASE MS-70 already in the slab.

I can't wait to hear some opinions

I probably used the wrong word "illegal", I should have used "misleading". The actual image used shows a 2012 ASE in a NGC slab which appears to be real, authentic, whatever. My scruples indicate "misrepresentation".

it being a presale that means you know they do not have the coin in hand so the picture is just a representative of what you will receive, so I don't think it is meant to deceive. The buyer will get a coin in a slab with the same grade for the price they paid
