First of all, I am not defending how this seller described the coin.

"Yeah... so this isn't a "material representation" yes and no, he can say "No material representations are made here as to grade..." and get away with it since he does not assign a specific MS- designation to the coin. In the item specifics he should not have been allowed to list the coin stating it was certified (NGC) since he did not provide a certification number.
