Overall, it looks pretty clean. I don't see any significant marks/scratches on either side. I'd say MS-64/65. The dark spot on the reverse at about 9:00 o'clock would be a stopper for me, however. This is a rather plentiful coin in higher mint state grades, I would hold out for one without any trace of an "issue."

Nice catch on the "spot" at 9 o'clock.

The images are not clear enough for me to offer an educated opinion on grade.
I can not see any serious troubles on the surfaces so I'd venture an estimate at mid-MS ... beyond that much clearer photos will be needed.
Like commems ... my personal aesthetic is for clean surfaces with a very minimum of blemishes. I note some blotches on the obverse (note the eagle breast and the rim toning at 3pm) coupled with some general surface staining issues on the reverse and the blotch at 9pm previously noted by commems.
The 1934 Texas is an excellent type coin with ample mintage (for the series) and many high grade examples (MS65 and better) available with truly spectacular surfaces ... with enough patience you can find one of them for little premium over an 'average' example.

Not the best photos but I'll take a shot at MS-65

commems made a very good observation on the reverse spot between "X" and "A" of TEXAS yesterday. Perhaps that is why it is $30 off of trends value of PCGS. Thanks!

I assume this is yours now?
If so ... congratulations indeed for acquiring a nice example of this great design classic silver commemorative.

Any Texas year/mintmark combo would be okay as long as it is a quality coin with eye appeal.
