Impossible to tell with out of focus photo and wear on coin, but the bust appears to be rounded so I would guess No-L.

Agree with no L. The bust looks rounded and not pointed.

I just contacted the seller and let him know that if he can't guarantee that it is an "L" to just refund me the money but if he can than great. I think that is certainly easier than going through the whole "item not as described" ordeal. I do see something that appears to be an "L" on the tassel but it could be something else like a ding or something. If he sends it, I will post a better pic. There seems to be significant wear around the face as well making it difficult to tell. If it is not an "L", it is going back "item not as described".

Yeah, I don't think it's an L. Been surprised on ebay before though, so maybe it will work out for you. If not, hope he does the right thing and sends your money back.

Not a big deal with ebay Buyer Protection. If it is an 1864-L, great. If he does the right thing if it isn't, that is fine too. There is always the option of opening a case if he sends it and everyone I encounter tells me it is not an "L".

The seller refunded my money. I said if they were 100% sure it was an "L" to ship it and told them about the rounded bust. No harm done, at least they didn't ship it anyway.
Edit: I just read the Paypal refund message and the seller said that she couldn't see the "L" and refunded my money.

At least they did the right thing in the end. I remember once when I was looking for my 70-S small date, I saw one on ebay and had a byt-it-now of $19.99. The pic was of the correct coin, but he sent me a 70-S large date. I emailed him and he said something to the effect of "Oops, I sent the wrong one. Send it back and I will replace it." So I did. He sent me another 70-S large date. I contacted him again. He admitted he had no idea which was which and just found those large dates, but figured they were basically the same. He then refunded all my costs. His eventual honesty was the only thing that kept me from leaving negative feedback, though my neutral feedback was still pretty scathing.

The seller just emailed me and said the owner of the coin reviewed it and said that it was mislabeled with an "L". Good thing I posted this. I couldn't see the "L" in the picture but thought there may be another way of detecting this a variety than the "L".
