I've been puzzling over the date on this one for a while now. I'm leaning towards 1828, but I'm not too sure. Thoughts?

the head looks more like a 1838

I don't see anything at all.

I know you're probably just curious as to what you have, but in case you're trying to gauge value, this coin is nearly worthless pretty much regardless of its date. On top of the graffiti, extreme wear, pitting, and holing, this coin may have even been cleaned at some point. Unless this was a chain cent, it has almost no value. As to the date again, maybe it's stronger in hand, but I can't even make out a single number.
