I would say that I agree that it should be on the slab, but if the pictures provided are of that coin, then it is a great error coin. However, if I was this seller, I'd send it back in for attribution and reslabbing. I don't believe that just stating the error on a slabbed coin without showing it on the slab is a good idea to get the full value for it.
Keep in mind that a submitter has to request an error or variety attribution from the TPG and there is a nominal fee for it. If the submitter didn't notice when he first submitted it (which I find hard to believe) or didn't feel that this error was worth the extra $5 or so and didn't submit the fee or request the attribution, it wouldn't be on the slab. NGC is not going to take that on themselves.
