this 1864 has a rounded bust, and can't have the L, right?

You are correct, and the bidders seem to see it too. The bidding should be into three digits, were it actually an "L."

That auction closed for $43.98 + 2.75 I'd hate to be whoever bought that when they find out the "L" is not there cause they paid 2X and then some more than the coin is worth.

I sent the seller a link to this thread, but they thought they saw an L in the headdress. Not much to say to that.

Yep--not the L--and hard to tell grade from that pic.
