Is This Seller Trying To Scam Me?

So on 4/28 around noon time I won an auction for 1982 P&D Souvenir Mint sets and paid within minutes via PP.

Same day around 4 PM the seller sent me a message via ebay letting me know he shipped the item and provided a USPS tracking number.

Per USPS the delivery ETA was 5/1 which seemed unlikely to me since the item was being shipped from California to New York. Normally that route takes 4-7 days usually.

Still to to this date the tracking number only shows:

April 28, 2014 , 3:21 pm
Acceptance
SOUTH GATE, CA 90280

April 28, 2014 , 5:03 pm
Depart Post Office
SOUTH GATE, CA 90280
Your item has left our acceptance facility and is in transit to a sorting facility on April 28, 2014 at 5:03 pm in SOUTH GATE, CA 90280. Information, if available, is updated periodically throughout the day. Please check again later.


That is the city that the seller is selling from per ebay, but there has been no changes in the tracking status. Also, it appears that he has signature confirmation on the tracking number. There's been no attempted deliveries to me in NY.

On 5/7 I messaged the seller asking what was going on and after no response on 5/8 I opened a case. I am now waiting until the time when I can escalate it to an ebay CSR. Still no response from the seller.


The seller has some neutral feedback which should have been a red flag. http://feedback.ebay.com/ws/eBayISA...d=true&rt=nc

Any other suggestions for me besides what I've already done? How would you expect this work work out? If the seller doesn't respond to the case by 5/14 will ebay simply issue a refund via PP? I've never had to deal with things like this from a seller before.

i would call the post office. its a pita to do. but call them and provide them with the trac number
they will tell where it is and where it is going
the reason I use money orders instead of pp. if something goes wrong. it is a federal offense to fraud someone using a money order. where as pp..your just screwed

Just so you know, Delivery Confirmation is not tracking. It is not guaranteed that it will be scanned along the way. It usually is, but not required and sometimes isn't.

I mentioned the 'signature confirmation' just to be clear that the USPS isn't trying to deliver it when I'm not home and leaving sticky notes on my door which isn't happening. I called the USPS and the first-level CSR was concerned enough to open a case. Today is day 14 of this, so I'm thinking regardless if there is activity on the tracking number or not, something is wrong if it's taking this long to deliver.

Something's very wrong, but it's with USPS and not the seller, since USPS acknowledges receiving the item. With that said, IMO the seller should be doing the USPS legwork, not you.

The USPS is becoming more & more undependable. I'd give it a couple more days.

Thanks for the replies guys. Yah I was wondering if something was up simply due to the no response from the seller, and still even no response from him after opening the case with ebay. I was more concerned about the possibility of forging tracking numbers so it looks like the item was sent, but never was.

You're probably right though Dave. Probably still sitting at the USPS in Cali or something.

It's killing me that this set is taking so long. It's the last thing I need to complete 1965 to date modern sets. I've been watching souvenir sets for months and do feel I got a good deal on it. Just hope it's not too good to be true.

good idea about opening the case, Even though the item was shipped its still the resonsibility of the seller to ensure it gets delivered or if in an extreme case open up a trace or claim if the item was insured.

If the item is sent with tracking I don`t think is the seller responsibility that the item gets delivered.

I think that you have plenty of time to receive your item and it's the seller who has to call USPS to know what's going on.

Yes, I agree with most above. It's on USPS. They flippin' lost it. Hopefully temporarily. I sent a regular first class letter last year that took a month to get from NY to CA. I had already refunded the seller his $, and the case had been long since closed. He was honest and sent me a check after he got it.

Today is about 21 days since the item was 'shipped' by the seller. The tracking number show no activity since the day it was dropped off at the post office in California. I opened a USPS case and had the case escalated to USPS Consumer Affairs; no response. Finally the waiting period on my ebay case is over and I escalated it to an actual ebay CSR. The CSR took my side and refunded my purchase + shipping to my Pay Pay. Still no communication coming back from the seller after this.

I am a little bummed about this, because I really did want the item, but I don't want to be stuck in a months long ordeal. I am assuming that the item was lost in the mail or stolen. I am not the only customer of this guys who was claiming the item not being delivered; maybe just a coincidence, maybe not. I hope that the item does not appear in my mail box three months from now and I have to deal with sending it back to the seller. I just want it to be done with and go purchase another set of coins -- but I don't know if I'll ever get this at this price...

If you receive it 3 months after, and you want the item, just contact the seller and pay for it!

next time something like that happens,,and the tracking number is not moving through the system
call the 800 number and talk to a real person.
they can track the package in real time
when the computer ells you it has left the sorting house
thats all the info it will give you.the operator can tell you if it is actuallly on the truck and where the truck is

i know this because a package was lost of mine.it was shipped from 100 miles from my house
i live inmississippi
the package went to tennessee,,then to ft lauderdale fla
then back to the sender..darn package took a better vacation than I do..

I agree that the delay/problem is with USPS, so the "scam" part of your post is ridiculous. As others indicated though, the burden is on the seller to get you the item you PAID them for. They should be tracking it and worried - because if USPS loses it they have to refund you in full and then deal with the $ lost on their end - insurance claim etc.

The seller is not off the hook just because it left them and USPS has it and that is known. Until you receive the item - the onus is still on the seller to get it to you!

Filing a case with ebay ( so you will be refunded if it never shows ) and suggesting the seller follow-up with USPS is the best plan. You did that and got refunded. Now if it shows it will be a happy surprise! Mail is lost all the time - it stinks when you happen to want the package a lot tho! At least you aren't out any $ on it. you chasing the package isn't necessary. The seller should be doing that as he is out the package worth until it is found.

You are completely wrong... People scam with money orders all the time. Once it is cashed, there is no way to get the money back. Fake ID's along with fake accounts are set up all the time.
Whether you use a postal or Western Union money order, you have absolutely no recourse.
With a credit card and Paypal, you have tons of recourse. I would never do a internet sale via money order. I occasionally buy stuff from other coin collectors and dealers and send checks, but, only after having established a relationship.
