http://www.ebay.ca/itm/canada-2000-...291313738459I bought this coin a few days ago ONLY because it was listed as sealed in the RCM packaging and it looked flawless in the photos. Otherwise I would not have bought it. I collect Privys for numismatic reasons, not stacking. This photo below is what I actually received. Clearly not as described. I've never been unsatisfied with an ebay purchase before. What should I do now? I don't want to be on the hook for return shipping when I've done nothing wrong and the seller made the error. Do I ask for compensation? Do I request he pay for return shipping? Do I just let it go? He has now relisted the flawless SML picture at $30+, much higher than what I paid. Maybe I got a low price and he gave me the worse one? Edited by wilsonwu89 12/11/2014 11:30 pm

I would contact the seller first, explain the situation and ask them how they would like to proceed. Think about how you would like the situation resolved and wait for their response. If the seller has a satisfactory answer, take it, if not propose your solution, if rejected, contact ebay and go their dispute process, just make sure you stay within ebay's time limits.

Check ebay policy, I believe they introduced a new buyer protection policy in nov., basically if there's a not as described dispute, the seller pays for shipping both ways. This is what makes me nervous about selling now. Also on Nov. 18 Paypal updated their protection policy to extend to 180 days or 6 months. These 2 changes have made many sellers nervous. Also take into consideration not all sellers will be aware of these changes. I try and stay as up to date as possible. Also a sale has 7 ways to earn defects and 8 defects from different buyers and your selling career is toast! Two ways of earning defects are: refunding a buyer and neutral or neg feedback. Check out the new policies that became effective in November , as a seller you too need to know them. I'd mention in your message you also sell and are aware of new selling policies, just leave it very general as I've done. This way it's not misinterpreted as a threat. I find when I mention I also sell, I get very different responses. Sellers tend to be more polite and on the up and up. Good luck!! Let us know what happens.

Always contact the seller first. Be clear that the item is "Not as described". If there is no response or no satisfactory response feel free to open an item "Not as described" case through eBay/Paypal. If the seller does respond then be prepared to either a) return the item for a full refund including shipping and preferably return shipping as well (justified as not as described); or b) have an amount for a partial refund in mind. Stick to your guns and remember that eBay/Paypal are on your side; not the seller's. So if it goes to their arbitration they will find in your favour. You don't need to accept less from the seller just to be 'nice'. Always be polite though.

Do you think it would be reasonable to just ask him $3 partial refund so that I paid close to melt value for the item?

You can try to go that route if you wish, but the best way is to proceed with opening a dispute with ebay and explaining that the item is not as described. I say this as an ebay seller -- making sure everything is done within the system not only assures you get the compensation you deserve, but also that the seller is properly held accountable for messing with with a deal. Those kinds of practices should ALWAYS be frowned upon and risk the legitimacy and reputation of all ebay dealers. The rest of us work hard to ensure we represent honest business on ebay and I don't want anyone else's actions sullying that effort.

Contact the seller and open a dialogue. There are all sorts of reasons why your coin might not match the description. Not all of them are malicious.

That's the thing though. If I go through ebay's process, Iam forced to pay return shipping even though it was not my error. Is there any way around this? :/

Contact the seller... Chances are they will be very reasonable and you can find a solution that works for both of you.

Like I stated previously, rules changed for sellers in November. When a case is filed with ebay, for not as described, the seller pays shipping both ways: to and from the buyer. Filing under Paypal you have 6 month to file a claim of not receive or not as described. You are also a seller; you need to be familiar with the policies of both ebay and Paypal. Take some time and read them, also you can post questions in eBays buyers forum, under ebay community. They're a very helpful bunch. Also when a buyer does a refund it earn one defect, and Paypal will not refund the seller their portion of the fees. Ask yourself as a seller, what would you do, if a buyer approached you with the same issue? You need to think about what you will be happy with, in terms of settlement. You need to be prepared for the seller to say return for refund. Some seller are very strict in doing return for refund. I wish you luck!

yes ebays new money back guarantee.. get the item you ordered or get your money back plus original shipping.
clearly he did not send you the coin in the photo, as he is using the exact photo again in a new auction. you won the auction fair and square and got a great price. I would first email him, and ask him why he didn't send you the sealed coin as pictured in the photo. if he doesn't make it right for you, you will have to open a case.
put be prepared to send coin back if you want your money back..

You will be on the hook for return shipping. I have only returned a couple things in my " ebay career" but had to pay both times for the return shipping. On top of that it has to be tracked which is a huge downfall for Canadians with our expensive shipping. If you ask for a partial refund and he refuses and you open a case I can guarantee ebay will say return for full refund. I believe it is the seller who makes that decision. Not ebay. So if he turned you down once he will do it again. Sending it back is not worth it. You can see if he will swap it out but that would be trust on both sides to be shipping back and forth without tracking. It appears that when it comes to these lower priced items the buyer gets screwed. I'd ask for a bit off $ off and if he refuses then decide what kind of feedback to leave him.

@silverwolf - Actually, it's not a new policy but a temporary sales gimmick thing for Xmas that sellers can opt into. This guy did so OP is good to go.
@pocket_change_50 - it only counts as a strike against the seller if the seller allows it to go to eBay/Paypal arbitration. If you open it and the seller settles it to your satisfaction then it's fine. As @UniversalCoins says, it's a good way to make sure there is a record of the problem in the system although personally I preferred to start with a regular message out of courtesy.
Since the seller is on the hook for the return shipping make sure you send it WITH TRACKING so they can't claim they didn't receive it.
