Two questions:

1. How did this have any chance of escaping the mint?
2. Could I legally spend it?

Some people collect blank planchets, dies and mint scrap so why not this? Maybe someone threw it in the garbage and it was seized by a coin collector, who knows....maybe, the mint is in on it...I was just posting it as a conversation piece, I would never purchase it even if I had the money, haha....

I wonder how many nail's the mint employee used to get the date almost centered on the nail.That slab should say "mint assisted error". I could believe a nut, a machine screw or even a washer but not a nail.It was done by an employee with access to the dies. believe what you like but there's no doubt about it.IMHO but still has a cool factor
