I'm gonna say MS64 , it has a bit of chatter on the bisons shoulder I can't tell a lot about the surface of the obverse but I don't see anything that would nock it below 64 ...

Weak strike, too much chatter, I'd say its a 62.

I felt the obverse was a weak strike, also noticed some markings on the buffalo's shoulder. If it gets an MS, maybe a 62. Seems to have good color and luster to it for eye appeal.

Have you examined the mint mark up close for and RPM? 1938 D has a few.

It seems that on average NNC graded coins are about 2-4 points overgraded !! So nnc ms67 would probably go ms63-64 at a legit TPG ..
I still buy nnc graded coins when I run onto one I like , I just make sure that what I pay is closer to what I assume the actual grade is rather than what it's labeled as ...

at some point you've got to learn to buy the coin and not the holder
these are just simply over-graded

Even with NGC and PCGS, remember to buy the coin and not the label. They aren't perfect either.
