What I am talking about is that this design did not exist in 1838; it ceased in 1836. It should have a skinnier bust on the obverse and HALF DOL. on the reverse.
This is an example of Davignon 1838 Obv3 RevE, counterfeit half. Keith Davignon is the author of the book "Contemporary Counterfeit Capped Bust half dollars" which was published in 1996 and identifies hundreds of counterfeits. This particular variety is considered extremely common.
